Copyright Infringement
- Notice of Copyright Infringement:
If you believe that your copyrighted work has been used in a manner that constitutes copyright infringement on Times of Rising, please submit a notice of infringement (“Infringement Notice”) in accordance with the requirements of the Indian Copyright Act, 1957.
Your Infringement Notice must include the following information:
- A physical or electronic signature of the person authorized to act on behalf of the copyright owner.
- A description of the copyrighted work that you claim has been infringed.
- The exact URL or a detailed description of where the allegedly infringing material is located on the Website.
- Your address, telephone number, and email address.

- Response to Notices:
Upon receiving an Infringement Notice, Times of Rising will take the following actions:- Remove or disable access to the infringing content.
- Notify the user who uploaded the content about the complaint and its consequences.
- Terminate accounts of repeat offenders in accordance with the policies outlined below.
- Counter-Notice by the User:
If you believe your content was wrongly removed due to a mistake or misidentification, you may submit a counter-notice to the Designated Copyright Agent.
The counter-notice must include:
- Your physical or electronic signature.
- Identification of the content that has been removed or disabled and the location where it appeared before it was removed.
- A statement under penalty of perjury that you have a good faith belief that the content was removed or disabled due to mistake or misidentification.
- Your name, address, telephone number, and email address.
- A statement that you consent to the jurisdiction of the courts of India and agree to accept service of process from the person who provided the original Infringement Notice.
Once a valid counter-notice is received, Times of Rising will forward it to the party who submitted the Infringement Notice. If the original complainant does not file a legal action within 10 business days, Times of Rising may reinstate the removed content.
Repeat Infringer Policy
Times of Rising has a policy of terminating the accounts of users who are found to be repeat infringers of copyrights, in accordance with Indian law and platform guidelines. A repeat infringer is defined as any user who has been notified of infringing activity more than once or whose content has been removed multiple times due to copyright complaints.
Fair Use and Other Defenses
Under the Indian Copyright Act, 1957, certain uses of copyrighted materials are considered “fair use” (e.g., for purposes such as criticism, comment, news reporting, teaching, scholarship, or research). If your use qualifies as fair use or another defence under applicable law, you should include an explanation of how your use falls under such an exception in your counter-notice.
Modification of This Policy
Times of Rising reserves the right to amend this Copyright Policy at any time. Any changes will be effective immediately upon posting on this page, and your continued use of the Website signifies your agreement to be bound by the modified terms.
Jurisdiction and Dispute Resolution
Any disputes arising under this Copyright Policy or related to copyright infringement claims will be governed by the laws of India, and all legal proceedings shall be conducted exclusively in the courts of India.
